Microsoft sues KK Software for Rs.5.71 Crore

Microsoft(NYSE:MSFT) has announced the filing of a copyright civil suit before the Delhi High Court for permanent injunction and damages against defendants Kamlesh Kumar Jha, the owner of M/s KK Software Solutions Pvt. Ltd, New Delhi and other defendants, for allegedly indulging in software piracy and counterfeiting of Microsoft products. As part of the civil claim, Microsoft has claimed a loss of Rs. 5.71 crore, which is the value of the illegal and infringing Microsoft software seized by the Central Bureau of Investigations (CBI) during the raids carried out at the premises of the defendants in December, 2009, basis the Criminal Complaint filed by Microsoft.
The multi-city and multi-state raids by CBI had led to the seizure of several types of infringing counterfeit Microsoft software and a large quantity of unauthorized packaging and printing material, blank Certificate of Authenticity (COA) stickers and other infringing evidence. CBI concluded its investigations and filed charge sheet against Jha and others before the Court of Chief Metropolitan Magistrate (CBI Cases) in December 2011 citing violations of the Copyright Act, 1957, the Information Technology Act, 2000 and the Indian Penal Code, 1860.
